Agreement to Terms

By downloading, installing, or using the HabitForge mobile application ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, then you may not access the Service.

Description of Service

HabitForge is a mobile application designed to help users track, build, and maintain positive habits. The Service includes features such as habit tracking, analytics, AI-powered insights, cloud synchronization, and premium subscription options.

User Accounts

Account Creation

• You must create an account to use certain features of the Service
• You are responsible for maintaining the confidentiality of your account credentials
• You must provide accurate and complete information when creating your account
• You are responsible for all activities that occur under your account

Account Termination

• You may delete your account at any time through the app settings
• We may terminate or suspend your account for violations of these Terms
• Upon termination, your data will be deleted within 30 days

Subscription Services

Auto-Renewal

• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions through your App Store account settings
• No refunds for the current subscription period upon cancellation

Free Trial

• Premium subscriptions may include a free trial period
• If you cancel during the free trial, you will not be charged
• Free trial automatically converts to paid subscription unless canceled

Acceptable Use

Permitted Use

You may use HabitForge for personal, non-commercial purposes to track and improve your habits.

Prohibited Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the Service or servers connected to the Service
• Reverse engineer, decompile, or disassemble the application
• Use automated systems to access or use the Service
• Share inappropriate, harmful, or offensive content
• Impersonate another person or entity

Intellectual Property Rights

Our Content

• The Service and its original content, features, and functionality are owned by HabitForge
• The Service is protected by copyright, trademark, and other intellectual property laws
• You may not reproduce, distribute, or create derivative works without our written permission

Your Content

• You retain ownership of any content you create or upload to the Service
• By using the Service, you grant us a license to use your content for providing and improving the Service
• You are responsible for ensuring you have the right to share any content you upload

Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices regarding your personal information.

Third-Party Services

The Service may contain links to or integrate with third-party services including:

• Google Sign-In for authentication
• Firebase for data storage and cloud services
• OpenAI for AI-powered insights
• Apple App Store for payments and distribution

These third-party services are governed by their own terms and privacy policies.

Disclaimers

Service Availability

• The Service is provided "as is" and "as available"
• We do not guarantee uninterrupted or error-free service
• We may suspend or discontinue the Service at any time with notice

Health and Wellness

• HabitForge is not a medical or therapeutic service
• The Service is not intended to diagnose, treat, or cure any health condition
• Consult healthcare professionals for medical advice

Limitation of Liability

To the maximum extent permitted by law, HabitForge shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses resulting from your use of the Service.

Indemnification

You agree to defend, indemnify, and hold harmless HabitForge from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service or violation of these Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state where the company is incorporated, without regard to conflict of law principles.

Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
